Relative Adoption (In-country)

1. Eligibility.

  • Prospective Adoptive Parents (PAPs) must be related to the child as defined at section 2 (52) of the JJ Act, 2015 i.e. paternal uncle or aunt, or a maternal uncle or aunt, or paternal grandparent or maternal grandparent.
  • The PAPs must be either Resident Indian or Non-Resident Indian (NRI) or an Overseas Citizen of India (OCI) residing in India for at least one year.

2. Procedure.

  • The PAPs shall register in Child Adoption Resource Information and Guidance System (CARINGS) and follow the procedure as provided in regulation 51 of Adoption Regulations, 2017. www.cara.wcd.gov.in/..........
  • Details of the documents required shall be as per Schedule VI.
  • Consent of biological parents shall be required as per in Schedule XIX. In case the biological parents are not alive, permission of the Child Welfare Committee (CWC) shall be required as per Schedule XXII.
  • The consent of the biological/adopted child of the PAPs and the child being adopted shall be obtained, if he is five years of age or above.
  • Affidavit of PAPs, in support of their financial and social status, shall be required as per Schedule XXIV.
  • The PAPs shall file an application in the competent court as provided in Schedule XXX (regulation 55 refers).
  • The court order shall be obtained and uploaded by the adoptive parent(s).
